Terms of service

§1. General provisions

1. These Terms set out the rules of providing electronic services by AVERN STUDIO Sp. z o.o., with its registered office in Warsaw (ul. Marszałkowska 1, 00-001), VAT ID PL000000000, KRS 0000000000 (the Seller), through the website at skillup.gg (the Service).
2. The Terms apply from 3 May 2026 and bind every User of the Service.

§2. Definitions

• Account — an individual User account created in the Service after registration.
• Course — a digital educational product (set of video lessons + optional e-book) made available to the User after purchase.
• Bundle — a set of several Courses offered for a single combined price.
• Coach — the person leading the Course whose likeness and materials are published on the Service.
• Entitlement — the User's time-limited right to access the Course, valid for 30 days from the date the order is paid, in accordance with §5.

§3. Technical requirements

• An up-to-date browser supporting HTML5 and HTTPS (Chrome, Firefox, Safari, Edge).
• An active internet connection of at least 5 Mbps for HD-quality video.
• Cookies and JavaScript enabled.
• DRM system: Widevine L1, FairPlay or PlayReady (typically built into the browser and operating system).

§4. Registration and Account

1. Creating an Account is free and requires providing an email address and password, or linking with an OAuth provider (Google, Discord).
2. The User undertakes to provide truthful data and to keep the password confidential.
3. The Seller may temporarily or permanently block an Account in case of gross violation of these Terms.

§5. Purchase and access to Courses

1. All prices of Courses and Bundles are stated in Polish złoty (PLN) and include 23% VAT.
2. Once payment is confirmed, the User receives a 30-day Entitlement to watch the videos and download the e-book.
3. After the Entitlement expires, the User may renew it with a 20% discount as a returning customer.
4. Access is tied to the User's Account and is non-transferable.
5. Every lesson is protected by DRM (Widevine L1) — copy attempts (OBS, Discord stream, etc.) result in a permanent black screen.

§6. Payments

1. Accepted payment methods: BLIK, payment card (Visa, Mastercard), Apple Pay, Google Pay and PayPal.
2. All payments are processed by Stripe Payments Europe Ltd. — the User's card details are not stored by the Seller.
3. A VAT invoice is issued automatically and available under Account → Orders.

§7. Right of withdrawal (digital content)

1. Pursuant to art. 38 point 13 of the Polish Consumer Rights Act, the right of withdrawal from a digital-content contract does not apply if performance has begun with the consumer's express consent before the 14-day period and the consumer has been informed of the loss of the right of withdrawal.
2. The User grants this consent by ticking the corresponding box in the cart before purchase — without this consent the purchase cannot be finalized.

§8. Complaints

1. Complaints regarding the Service or the quality of Courses should be submitted electronically to kontakt@skillup.gg.
2. The Seller will examine the complaint within 14 days of receipt.
3. The consumer has the right to use out-of-court complaint resolution methods, including the European Commission ODR platform (ec.europa.eu/consumers/odr).

§9. Copyright

1. All materials (videos, e-books, descriptions, graphics) are protected by the copyright of the Seller or the Coaches.
2. The User obtains a non-exclusive, non-transferable license for personal use only.
3. Copying, redistribution, publication on social media or commercial use of the materials without the Seller's written consent is prohibited.
4. Copyright infringement may result in account suspension as well as civil and criminal liability.

§10. Final provisions

1. The Seller reserves the right to amend these Terms — Users will be notified by email 14 days in advance.
2. Polish law applies. Disputes are resolved by the court competent for the Seller's registered office, unless statute provides otherwise (e.g. for consumers).
3. Matters not regulated by these Terms are governed by the Polish Civil Code, the Act on the Provision of Electronic Services and the Consumer Rights Act.
